1. Acceptance
By downloading, installing or using the App, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the App.
2. Purpose
The App displays compatible-ring and authorised Health Connect information, presents general trends, supports breathwork and workouts, and allows deliberate exports. It is a general wellbeing and performance product.
3. Hardware and compatibility
Some functions require a compatible smart ring and Android device. Compatibility and available measurements depend on ring model, protocol, firmware, fit, Android version and phone manufacturer.
4. No medical service
The App is not a medical device and does not provide medical advice, diagnosis, treatment, emergency monitoring or clinical decision support. Do not use its outputs as the sole basis for health, medication, treatment, safety or emergency decisions.
5. Safe use
Stop a breathing exercise if concerning symptoms occur. Do not use guided breathwork while driving, operating machinery, in water or in an unsafe setting.
6. Licence and acceptable use
You receive a limited, personal, non-exclusive, non-transferable and revocable right to use the App. You must not unlawfully copy, sell, sublicense, disrupt, reverse engineer, circumvent security, introduce malicious software, misrepresent another person's health information, or use the App for unlawful discriminatory or high-impact decisions.
7. User responsibility
You are responsible for device security, correct ring connection, permission choices, export recipients, appropriate backups, safe use and obtaining professional advice when needed.
8. Availability
Features may change or be discontinued. Uninterrupted operation, complete synchronisation and recovery of every missing reading are not guaranteed.
9. Third parties
Android, Health Connect, email and sharing apps, hardware providers, weather services and optional online coach providers have separate terms and privacy practices.
10. Purchases and consumer rights
The App may be separate from ring, coaching or service purchases. Separate sales, warranty and refund conditions may apply. Nothing excludes rights that cannot lawfully be excluded under the Australian Consumer Law.
11. Liability
To the maximum extent permitted by law, Elite Performance Through Breath is not liable for indirect, incidental, special or consequential loss arising from use of or inability to use the App. Nothing limits liability where doing so would be unlawful.
12. Governing law
These Terms are governed by Queensland law, subject to rights that cannot legally be restricted.
